Thank you guys for your responses and i will update firmware and imgburn. However, as far as my issue is concerned, it turned out to be something so simple that I am kickng myself in the groin!! Like most problems i skipped right over the most obvious fundamental stuff that could be the problem and jumped straight into making it WAY harder than it needed to be. The Verbatim DL discs I have are actually 8x when i thought they were 2.4x!! I had my write speed setting set to 2.4 in Imgburn so when i changed it to 8x....no wories. Again thanks for the help tho!

I am using Verbatim DL 2.4x discs. It burns the first layer just fine and then i get an I/O error at about 54% everytime on the second layer!
