audio cd issues with LG GSA-H12N?

I get this error on cue sheets created with foobar or imgburn. It works fine with Pioneer 111L and Benq 1655. The LG drive has updated firmware and i'm using verbatim cd-r (i know its cmc but who cares lol) i'm using xp pro.

so i'm assuming this is not imgburn but a hardware issue?
